Terms of Service

These Terms of Service ("Terms") govern your use of the Dagning application and related services ("Service") provided by Enkel Labs, a Swedish sole proprietorship (enskild firma) based in Stockholm, Sweden ("we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Dagning is a mobile application for the boards of Swedish housing cooperatives (bostadsrättsföreningar, "BRF"). It helps boards organize their work: tasks, documents, meeting minutes (protokoll), digital signing with BankID, and communication within the board and the association. The Service is available through the Apple App Store and Google Play.

2. Accounts and who these Terms bind

To use the Service, you need an account. You can sign in with email and password, Google Sign-In, or Sign in with Apple. You are responsible for keeping your account credentials secure, and you may only create one account per person.

These Terms apply on two levels:

• As an individual user, you accept these Terms for your own use of the Service.
• On behalf of a BRF: if you create or administer an association (förening) in the Service, you accept these Terms on behalf of that BRF and confirm that you are authorized to do so (for example, as a member of its board). At the same time, the BRF and Enkel Labs enter into the Data Processing Agreement (personuppgiftsbiträdesavtal), which governs our processing of personal data on the BRF's behalf.

If we have reason to believe an account violates these Terms, we may suspend or terminate it.

3. Trial, pricing, and payment

New associations receive a free trial period. The current trial length and pricing are stated at dagning.app/#pris.

• No payment details are required during the trial.
• The trial does not convert automatically into a paid subscription. A subscription begins only when the BRF actively orders one. If the trial ends without an order, the association's access to paid features ends — nothing is charged.
• After the trial, the Service is priced per apartment per month, as stated in the current price list. Special offers (for example, discounted pricing for early customers) are described in the price list and apply as stated there.
• Fees are invoiced (faktura) to the BRF.
• There is no binding period. The BRF may cancel at any time, with effect from the end of the period already invoiced.

We may change prices for future periods. Price changes are announced in advance and never apply retroactively to periods already invoiced.

4. Your content

The BRF and its users own all content created through the Service, including tasks, documents, messages, minutes, and any other data entered. We claim no ownership or intellectual property rights over your content.

By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of operating the Service (for example, syncing data between the devices of the association's members and delivering documents for signing at your request).

5. Encryption and how your data is stored

Your association's content is protected with end-to-end encryption (AES-256-GCM). Encrypted content cannot be read on our servers.

For transparency, the following is not end-to-end encrypted:

• your account email address;
• the name of your association;
• technical synchronization metadata (such as timestamps, device identifiers, and version/vector-clock data);
• push notification tokens;
• encrypted key material ("wrapped" keys, which we cannot unwrap).

In addition, content leaves the encrypted envelope in two situations you initiate: documents you send for BankID signing are processed by our signing provider (see Section 6), and emails we send you are delivered through our email provider. Details are in our Privacy Policy.

Your devices are the primary record. Our server acts as a synchronization relay: data written to the server is automatically deleted after 14 days. The full, durable copy of your association's data lives on the devices of its members and, if enabled, in daily encrypted backups to your own Apple iCloud or Google Drive account. New devices are seeded from the association's existing devices.

This means:

• If you lose your encryption passphrase, we cannot recover your data. You are solely responsible for safeguarding it.
• If all of an association's devices and backups are lost, the data cannot be recovered by us. We recommend keeping backups enabled on at least one device.
• Backups stored in iCloud or Google Drive reside in your own accounts and are subject to the respective provider's terms. We are not responsible for the availability or data handling of those providers.

6. Digital signing with BankID

The Service lets you sign documents (for example, board minutes) with BankID through our signing provider, Idura. When you send a document for signing, the document is transmitted to Idura, and the signed PDF returned to you includes a signature page and embedded signature evidence — including the signers' names and personal identity numbers (personnummer) — as is standard for BankID signatures.

Signed documents are stored like all other content: end-to-end encrypted, on the server for at most 14 days, and durably on your devices.

You are responsible for ensuring that you have the right to send a document for signing and that the signers are the appropriate persons under your association's rules.

7. Acceptable use

You agree not to use the Service to:

• violate any applicable laws or regulations;
• infringe on the rights of others;
• distribute malware or attempt to compromise the Service's security;
• interfere with or disrupt the Service or its infrastructure;
• share your account credentials or allow unauthorized access.

8. Availability and changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may modify, suspend, or discontinue any part of the Service. If we make changes that materially affect your use, we will make reasonable efforts to notify you in advance.

9. Data protection

Our handling of personal data is described in our Privacy Policy. For personal data that the BRF enters into the Service (such as information about its members), the BRF is the data controller and Enkel Labs is the data processor under the Data Processing Agreement.

10. Intellectual property

The Dagning application, including its code, design, branding, and documentation, is owned by Enkel Labs and protected by applicable intellectual property laws. These Terms grant you no rights to our intellectual property beyond the right to use the Service as intended.

11. Termination

You may stop using the Service and delete your account at any time, directly in the app. A BRF may end its use of the Service at any time as described in Section 3.

When an account or association is deleted, or when devices stop syncing, any data on the server is automatically deleted within 14 days by design. Copies on your devices and in your own cloud backups remain under your control.

We may suspend or terminate access if these Terms are violated or if we discontinue the Service. Where possible, we will give reasonable notice and an opportunity to export your data.

12. Limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied.

To the maximum extent permitted by applicable law, Enkel Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total aggregate liability for any claims relating to the Service is limited to the fees paid by the BRF for the Service during the twelve months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

13. Governing law and disputes

These Terms are governed by the laws of Sweden. Any disputes arising from or relating to these Terms or the Service shall be resolved by the courts of Stockholm, Sweden.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Language versions

These Terms are provided in Swedish and English. In case of discrepancies between the language versions, the Swedish version prevails.
